Dear Sir,
the undersigned represents FRENI BREMBO S.P.A., having its registered offices in Via Brembo 25- Curno (BG) – Italy, the owner of numerous international and national Trademark registrations, either consisting of or containing the denomination “BREMBO”, “AP RACING” and others, including in particular:
- INT. Trademark No. 1014999 – Nice Classification: 1, 3, 5, 9, 12, 14, 16, 18, 25, 28;
- INT. Trademark n. 1152010 – Nice Classification: 7, 9, 12, 18, 25, 35, 37, 42;
- INT. Trademark No. 1152011 – “BREMBO” – Nice Classification: 7, 9, 12, 18, 25, 35, 37, 42;
- TH Trademark No. 171105532 – Nice Classification: 12.
These names and trademarks are valuable assets of FRENI BREMBO S.P.A., who, as the only legitimate owner of such trademark registrations, will take all reasonable steps to properly protect them.
Your website has been registered and is being used in bad faith, in order to attract unaware Internet users and sell them counterfeit items bearing our Client’s trademark.
You are offering for sale counterfeit BREMBO products at the following webpages:

Such offerings constitute and evident Intellectual Property rights infringement, a Commercial unfair practice and a violation of the Consumer protection regulations, via inducing unaware visitors into buying counterfeit products advertised as authentic.
By misappropriating the naming rights, Trademarks and logos of our Client, you are generating a relevant risk of Consumer confusion, because Internet users could be induced to think that such website is sponsored by, affiliated with or otherwise approved by the legitimate rights owner, i.e. FRENI BREMBO S.P.A.
Accordingly, our Client kindly asks that you expeditiously cease and desist from publishing such content which infringe upon the trademarks owned by FRENI BREMBO S.P.A. and that you immediately remove such items form your website.
Our Client furthermore requests that you, no later than
Wednesday April 10th, 2019
provide written assurances that you have affirmatively removed all the illegitimate “BREMBO” offerings, that you will not start any new illegitimate business in association with the concerned Trademark and that you will not register any domain like the trademark at issue.
Should you comply with the above requests, our Clients believe that this matter can be resolved amicably.
Otherwise, FRENI BREMBO S.P.A. will take additional legal steps under applicable civil and/or criminal laws and regulations including damage compensation claims to preserve its valuable Intellectual Property assets.
